Mr. Friedli had made an arrangement in 1991 to sell this car and 3 other Ferraris to Guiseppe Guidice. It was entirely undocumented. Unable to locate the cars,Mr. Friedli filed a criminal proceeding in Marbella. The car was at Motorauto in Marbella where it was impounded. He claimed that they had fraudulently appropriated the cars in the deal. The court dismissed the case due to a lack of evidence.
Mr. Friedli filed a civil suit but it too was dismissed due to insufficient evidence that the contract was how he claimed it was. In the civil suit, he claimed that the transaction was a contract of sale and that Motorauto and Guidice had breached the contract by refusing to pay what Mr.Friedli claimed was the full purchase price. It became a Decree Absolute in 2000 after being affirmed on appeal. After it was imported to the United States, he filed a second criminal case against Motorauto for violating the impound but it was dismissed as Motorauto was not notified about the civil case. They were barred from saying that this car was stolen. The Friedli heirs would disclaim their interest in the car and confirmed they had no interest.
There would be an entry of judgement against Dr.Gerber in Connecticut. Gerber challenged the Jurisdiction and claimed that he had not been properly served in the Court Process which was largely not true and tried to have the case dismissed. However, it didn't get very far as Dr.Gerber reversed course.He simply quit, refused to participate, and withdrew his filings. The final Judgement in 2018 meant that Dr.Gerber cannot interfere with the owner of this car and that he has no interest in it.
Originally Finished In Nero with Naturale Connolly Interior. Fitted with disc brakes and Borrani wire wheels at the Factory in 1961.
